The 47-year-old rapper – real name Earl Simmons – was taken into custody in a court in Manhattan for failing drug tests according to TMZ on Tuesday.
The site reports that it is a violation of his tax case which he pleaded guilty to last month to dodge the $1.7 million in taxes he’d otherwise owe.
TMZ reports that the judge ruled the Ruff Ryders Anthem hitmaker was a flight risk as he had tested positive for opiates, cocaine, and oxycondone. He was supposed to be completing rehab.
The site also reports that US Attorney Spokesman Nicholas Biase said prosecutors had referenced a video TMZ published last week in which DMX was seen preaching at a hotel bar.
They claimed that witnesses said he was drinking and buying shots for other customers at the bar as drinking is also a probation violation.
His attourney Murray Richman told the site: ‘I’m saddened and disappointed. We’ll have to deal with it accordingly.’
DMX faces up to five years in prison when he is sentenced in Manhattan federal court.
Judge Jed Rakoff set sentencing for March 29, though the date is likely to be postponed as DMX continues rehabilitation for drug and alcohol issues.
The 46-year-old hip-hop artist and actor was arrested last summer.
