MIGORI 18TH JANUARY 2018: Migori High Court has allowed the scrutiny of forms 35A that were used in the declaration of the results for Member of Parliament in Suna West Member constituency in all the 88 polling stations.
The results declared Peter Masara who vied as an independent candidate as the winner ousting Joseph Ndiege who lodged a petition against the election declaration.
High Court Judge Hillary Chemitei allowed the scrutiny of the forms that were used to declare the results at the polling stations and ordered that they then be produced in the same court after seven days.
The petitioner had asked the court to allow him to do a thorough scrutiny after which the registrar of the Migori High Court will avail a report on the same.
The respondent lawyer Omondi Kisera exuded confidence in the way in which the court allowed the process to be undertaken.
"The forms were used to declare the victory and it is the same forms that are to be scrutinized by both parties to know the authenticity of the case," said Mr. Omondi.
